Liability and Policy Issues For State And Local Police

Failure to understand the distinction between so-called immigration warrants issued by an immigration judge or traditional arrest or search warrants issued by a federal court judge can lead to liability claims against the individual officer, as well as their department and governmental entity.

Immigration law allows administrative warrants that authorize immigration officers to arrest a person for civil immigration violations. Administrative immigration warrants do not authorize searches and generally do not authorize entry into private homes or non-public areas without consent.

Only a judicial warrant signed by a federal or state judge or magistrate can authorize a search of property.
